Terms and Conditions of Service
The terms on which Senditt arranges the carriage of your freight.

These are the freight carriage terms referred to in the Customer Account Application Form and the Credit Card Authorisation Form. For the terms governing use of the Senditt platform and website, see our Terms of Service.

1. Definitions
"Senditt", "we", "us" means SENDIT TRANSPORT LOGISTICS PTY LTD (ABN 79 696 920 546) trading as Senditt.
"Customer", "you" means the person or entity that opens a Senditt account or requests Services, and includes any person acting on the Customer's behalf.
"Carrier" means any third-party transport or courier company, and its subcontractors, engaged through the Platform to carry Goods.
"Goods" means the items tendered by or on behalf of the Customer for carriage.
"Platform" means the Senditt online freight management platform at senditt.au and any related booking, tracking, labelling or invoicing tools.
"Services" means the freight management services provided by Senditt, including quoting, booking and arranging carriage of Goods with Carriers, consignment management, tracking, and account management.
"Receiver" means the consignee nominated by the Customer to receive the Goods.
2. Nature of Services and Not a Common Carrier
Senditt is a freight management provider. Senditt arranges carriage of Goods through Carriers via the Platform and does not itself operate vehicles or physically carry Goods unless expressly agreed in writing. Senditt is not a common carrier and accepts no liability as such.
Carriage of Goods is performed by the Carrier selected at the time of booking and is subject to that Carrier's conditions of carriage, service coverage, transit times and item restrictions, in addition to these Terms. Senditt may in its absolute discretion:
- refuse to arrange carriage of any item for any person or entity;
- open, inspect, weigh or measure any package tendered for carriage, or permit a Carrier to do so; and
- substitute an alternative Carrier or service where the selected Carrier is unable to perform the Service, using reasonable efforts to notify the Customer.
Transit times quoted on the Platform are estimates provided by Carriers and are not guaranteed.
3. Customer Warranties and Acknowledgments
The Customer warrants that the person who tenders Goods for carriage or makes a booking on the Platform has authority to do so and to accept these Terms and the Carrier's conditions on behalf of the Customer, the owner of the Goods and the Receiver.
Where the Customer is not the owner of the Goods, the Customer warrants that it has full authority to act as agent of the owner and indemnifies Senditt against all liability arising in connection with the Goods.
The Customer warrants that:
- all descriptions, dimensions, weights, quantities, values, addresses and other details entered into the Platform or otherwise supplied are complete and accurate;
- the Goods are packed, labelled and secured in a manner adequate to withstand the ordinary risks of carriage, having regard to their nature;
- the Goods comply with all applicable laws and regulations relating to their nature, packaging, labelling and transport; and
- any dangerous goods are declared in full at the time of booking and are within the classes and quantities the selected Carrier accepts.
The Customer indemnifies Senditt and each Carrier against all loss, damage, expense, penalties and fines arising from any inaccuracy or omission in the details supplied, or from any breach of these warranties.
4. Insurance and Transit Warranty
It is the Customer's responsibility to arrange suitable insurance for the Goods. Transit insurance or warranty is not included in the Services unless requested by the Customer and confirmed by Senditt in writing at the time of booking, in which case the cover, exclusions and claim process will be as set out in that confirmation. The Customer releases Senditt from any liability arising from a failure of any policy of insurance to cover a loss.
5. Liability and Claims
To the maximum extent permitted by law, Goods are at the risk of the Customer and not Senditt, and Senditt is not liable, in contract, tort (including negligence), statute or otherwise, for any loss of, damage to, deterioration of, delay in delivery of, mis-delivery of or failure to deliver the Goods, or for any consequential or indirect loss, however arising, including from any act or omission of a Carrier.
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy under the Australian Consumer Law or other law that cannot lawfully be excluded. Where such a law applies and permits limitation, Senditt's liability is limited, at Senditt's option, to supplying the affected Service again or paying the cost of doing so.
Senditt will, on request and at no additional charge, lodge and manage a claim with the relevant Carrier on the Customer's behalf under that Carrier's conditions of carriage. Any recovery from a Carrier will be passed on to the Customer. The Customer acknowledges that Carrier liability is typically limited and subject to strict time limits. No claim will be accepted unless:
- for damage or shortage, written notice is given to Senditt within seven (7) days of delivery, with damage noted on the proof of delivery at the time of receipt where possible;
- for non-delivery, written notice is given to Senditt within thirty (30) days of the date the Goods were despatched; and
- all information reasonably requested by Senditt or the Carrier, including photographs, invoices and packaging evidence, is provided within fourteen (14) business days of the request.
Claims not made in accordance with this clause are waived. Claims may not be set off against, or used to withhold payment of, any invoice.
6. Delivery
The Carrier is authorised to deliver the Goods to the address nominated by the Customer, and delivery is deemed complete where the Carrier:
- obtains a signature from any person at the delivery address who presents as the Receiver or its agent;
- delivers in accordance with an Authority to Leave (ATL), whether standing or per consignment, given by the Customer or the Receiver through the Platform or otherwise; or
- makes the Goods available for collection from the Carrier's depot after a failed delivery attempt.
Goods delivered under an Authority to Leave are at the Customer's sole risk from the time they are left. Where delivery cannot be completed, redelivery, storage, return-to-sender and futile pickup charges may apply at the rates displayed on the Platform or advised by Senditt, and the Carrier may return the Goods to the Customer if delivery or collection is not completed within seven (7) days.
7. Charges and Payment
The Customer is liable for all charges incurred in the provision of the Services. Charges are as quoted on the Platform at the time of booking and are based on the details entered by the Customer. Where a Carrier records different dimensions, weight, item count, service or address from those entered, the charges will be adjusted and re-invoiced accordingly, together with any applicable Carrier surcharges for re-measurement, dangerous goods, residential, remote or restricted-area delivery, oversize items or manual handling. All charges are exclusive of GST unless stated otherwise.
Trading terms are strictly seven (7) days from invoice date, unless otherwise agreed by Senditt in writing. Payment may be made by EFT to the account nominated on the invoice or by credit card under a signed Credit Card Authorisation Form. A surcharge of 1.5% applies to credit card payments where permitted by law.
If any amount is not paid by its due date, Senditt may, without prejudice to any other right:
- suspend or cancel the Customer's account and any bookings in progress;
- charge interest on the overdue amount at the rate prescribed under the Penalty Interest Rates Act 1983 (Vic) plus 2% per annum, calculated daily until paid;
- recover from the Customer all costs of recovery, including debt collection and legal costs on a full indemnity basis; and
- withdraw any agreed credit terms and require payment in advance for future Services.
The Customer may not set off any amount it claims is owed by Senditt or a Carrier against any amount payable to Senditt. Where a dispute arises between the Customer and a Receiver or any other party as to who is liable for charges, liability remains with the Customer at all times. Invoices are deemed accepted unless disputed in writing within seven (7) days of the invoice date.
8. Nature of Goods
The Customer must not tender for carriage:
- any item exceeding the dimension or weight limits of the Carrier selected, as displayed on the Platform or advised by Senditt in writing;
- cash, bullion, jewellery, precious metals, negotiable instruments, firearms, illegal items, livestock, human remains, or any item the selected Carrier excludes; or
- dangerous goods, hazardous, flammable, explosive, radioactive or offensive items, unless declared at the time of booking, packed and labelled in accordance with the Australian Dangerous Goods Code, and within the classes and quantities the selected Carrier accepts.
Goods tendered in breach of this clause may be refused, held, returned, destroyed or disposed of by the Carrier at the Customer's cost, and the Customer indemnifies Senditt and the Carrier against all resulting loss, charges and penalties.
9. Booking Channels and Platform Use
Bookings may be placed through the Senditt Platform, by email to customercare@senditt.au, or by phone on 0433 173 504. Bookings placed by email or phone are entered onto the Platform by Senditt on the Customer's behalf and are subject to these Terms in the same way as bookings placed directly. Where a booking is placed by email or phone, the consignment details recorded on the Platform are taken to be the Customer's instructions unless the Customer notifies Senditt of an error before the Goods are collected.
The Customer is responsible for all bookings, changes and instructions made through the Platform using its login credentials, and must keep those credentials secure and notify Senditt immediately of any unauthorised use. The Customer must not use the Platform for any unlawful purpose or in a manner that interferes with its operation. Senditt may suspend Platform access for maintenance, security or non-payment. Rate and service information displayed on the Platform is confidential to the Customer and must not be disclosed to third parties.
10. Privacy and Credit Information
Senditt collects personal information, including contact details of the Customer, its staff and Receivers, for the purpose of providing the Services and managing the Customer's account, and may disclose it to Carriers and service providers for those purposes. Senditt handles personal information in accordance with the Privacy Act 1988 (Cth). By applying for an account, the Customer consents to Senditt obtaining and using credit reporting and trade reference information to assess the application and manage the account, and to Senditt disclosing default information to credit reporting bodies and collection agents where permitted by law.
11. Carriers and Subcontractors
Senditt is authorised to engage any Carrier, and each Carrier may subcontract the whole or any part of the carriage. Every exclusion, limitation, indemnity and right in these Terms in favour of Senditt also extends to and protects each Carrier, its subcontractors and their respective employees and agents, and Senditt holds the benefit of those provisions on trust for them. The Customer undertakes not to bring any claim against any Carrier, subcontractor, employee or agent that seeks to impose liability beyond that provided for in these Terms and the Carrier's conditions of carriage, and indemnifies Senditt against the consequences of any such claim.
12. Force Majeure
Neither Senditt nor any Carrier is liable for any delay, loss or damage arising wholly or partly from causes beyond their reasonable control, including natural disaster, extreme weather, fire, flood, pandemic, industrial action, act of war, civil unrest, government action, or failure of infrastructure, networks or third-party systems.
13. General
These Terms, the Customer Account Application Form, any Credit Card Authorisation Form and any written confirmation issued by Senditt together form the entire agreement between the Customer and Senditt and prevail over any terms in the Customer's purchase orders or other documents. Senditt may amend these Terms by publishing an updated version at senditt.au/terms, and the amended Terms apply to bookings made after publication. If any provision is invalid or unenforceable it is severed to the extent necessary and the remainder continues in force. These Terms are governed by the laws of Victoria, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of Victoria.
